This website is operated by PawVitalCo. Throughout the site, the terms "we", "us" and "our" refer to PawVitalCo. PawVitalCo makes this website available to you, the user, together with all information, tools, products, digital content and services offered on it, conditional upon your acceptance of all the terms, conditions, policies and notices set out here.

By visiting our site and/or making a purchase from us, you use our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including the additional terms, conditions and policies referenced herein and/or accessible by hyperlink.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, merchants and/or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service.

If you do not agree to these Terms of Service, you must not access the website or use our Services.

Any new features, products, content or tools added to the current store will also be subject to these Terms of Service.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms by posting updates and/or changes to our website, subject to applicable law.

Continuing to use or access the website after changes are posted constitutes acceptance of those changes, to the extent permitted by applicable law.

Our store is hosted by Shopify. Shopify provides the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms of Service, you confirm that you are at least the age of majority in your country or jurisdiction of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site.

You may not use our products, our website or our Services for any illegal or unauthorised purpose, nor may you, in using the Services, breach any laws applicable in your jurisdiction, including copyright and intellectual property laws.

You must not transmit any worms, viruses, malicious code or any code of a destructive or harmful nature.

Any breach or violation of these Terms may result in the suspension or termination of your access to the Services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service, cancel transactions or restrict access where we reasonably consider it necessary, including in cases of suspected fraud, abuse, illegal activity, misuse of our Services or breach of these Terms, subject to applicable law.

You understand that your content, excluding full payment card details, may be transferred across various networks and may undergo technical changes necessary to conform and adapt to the requirements of connecting networks or devices.

Payment information is processed using secure payment systems and is encrypted during transmission, where applicable.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, access to the Service, or any contact through which the Service is provided, without our express written permission.

The headings used in these Terms are for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 — ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We take reasonable steps to ensure that the information made available on our website is accurate and up to date. However, we do not warrant that all general information content will always be complete, current or free of errors.

The content on this site may be provided for general information and educational purposes only, and should not be relied upon as the sole basis for your decisions.

You rely on the general information provided through the site at your sole discretion and your own risk.

The site may contain historical information. This historical information is not necessarily current and is provided for reference only.

We reserve the right to modify the content of the site at any time, subject to our obligations under applicable law.

Nothing in this section limits any rights you may have under applicable consumer law.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products and Services are subject to change without notice, except where you have already entered into a binding purchase contract at an agreed price.

We reserve the right to modify, suspend or discontinue the Service, or any part of it, at any time.

We will not be liable for any modification, price change, suspension or discontinuation of the Service, except where such liability cannot lawfully be excluded or where an existing customer contract requires it.

SECTION 5 — PRODUCTS OR SERVICES

Certain products or Services may be available exclusively online through the website.

These products or Services may be available in limited quantities and may only be returned, refunded or exchanged in accordance with our Return and Refund Policy and applicable law.

We make every effort to display the colours, images, packaging and appearance of our products as accurately as possible. However, we cannot guarantee that the display on your device will accurately reproduce every colour, size, texture or visual detail.

Product packaging, labelling or presentation may occasionally differ from the website images where there is a manufacturing, supplier or packaging update, provided the product supplied remains substantially as described.

We reserve the right, but are not obliged, to limit the sale of our products or Services to any person, geographic region or jurisdiction, where legally possible.

We may exercise this right on a case-by-case basis.

We reserve the right to limit product quantities, in particular where we reasonably suspect reselling activity, fraud, abuse of promotional offers, stock limitations or other legitimate business concerns.

All product descriptions and product prices may change at any time without notice, subject to orders already confirmed and applicable law.

We reserve the right to discontinue any product at any time.

Any offer of a product or Service is void where prohibited by law.

SECTION 6 — 90-DAY MONEY-BACK GUARANTEE, RETURNS AND REFUNDS

Eligible PawVitalCo physical products may be covered by our 90-Day Money-Back Guarantee, subject to the conditions and eligibility criteria set out in our Return and Refund Policy.

The 90-day period is calculated from the date of delivery, unless otherwise stated in the applicable promotion or the Return and Refund Policy.

To request a refund under the 90-Day Money-Back Guarantee, you must contact us at care@pawvitalco.com within the applicable 90-day period and provide your order number together with any information reasonably requested to review your request.

The 90-Day Money-Back Guarantee is separate from, and does not limit, any statutory rights you may have under applicable UK consumer law.

Refund and return requests may be subject to reasonable eligibility criteria, fraud-prevention checks and the conditions set out in our Return and Refund Policy.

We reserve the right to refuse fraudulent, abusive, duplicated or otherwise illegitimate requests.

For full details, please see our Return and Refund Policy.

SECTION 7 — DIGITAL PRODUCTS AND eBOOKS

We may offer digital products, including eBooks, downloadable guides, digital educational materials and other content delivered electronically.

Except where required by applicable law, digital products and eBooks are non-refundable once they have been delivered, accessed, downloaded or otherwise made available for use.

Where an eBook or other digital product is provided free of charge as part of a promotion, bundle, gift or purchase offer, it has no separate cash refund value and cannot be exchanged for money, credit or another product, except where we expressly agree.

Where applicable law grants you a right of cancellation for digital content, that right may be affected once the supply of the digital content begins with your prior express consent and acknowledgement, where legally valid.

Nothing in this section limits any rights you may have where digital content is faulty, substantially not as described or otherwise not compliant with applicable law.

SECTION 8 — ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse, limit or cancel an order where reasonably necessary and permitted by law.

We may limit or cancel quantities purchased per person, per household, per payment method or per order.

These restrictions may apply to orders placed through the same customer account, the same payment method, or using the same billing and/or delivery address.

Where we change or cancel an order after it has been submitted, we may attempt to notify you using the email address, billing information or phone number provided when ordering.

We reserve the right to limit or prohibit orders that, in our reasonable judgement, appear to be placed by resellers, distributors or unauthorised traders.

You agree to provide current, complete and accurate purchase and account information for purchases made in our store.

You agree to promptly update relevant account information, including your email address and payment information, so that we can complete transactions and contact you as needed.

For more details, please see our Return and Refund Policy.

SECTION 9 — OPTIONAL TOOLS

We may provide access to third-party tools that we neither monitor nor necessarily control.

You acknowledge and agree that third-party tools may be provided "as is" and "as available", subject to the third party's own terms and conditions.

To the fullest extent permitted by law, we are not responsible for third-party tools that are beyond our control.

Any use by you of optional third-party tools offered through the site is at your discretion, and it is your responsibility to ensure that you understand and accept the terms on which those tools are provided.

We may also offer new Services, features, tools or resources through the website in the future. Such additions will also be subject to these Terms of Service, unless otherwise stated.

SECTION 10 — THIRD-PARTY LINKS

Certain content, products and Services available through our Service may include materials, integrations or services provided by third parties.

Third-party links may direct you to websites that are neither affiliated with nor controlled by PawVitalCo.

We are not responsible for reviewing or evaluating all content, accuracy, security, availability or practices of third parties.

To the fullest extent permitted by law, we disclaim all liability for third-party websites, materials, products or services beyond our control.

SECTION 11 — COMMENTS, REVIEWS AND OTHER USER CONTRIBUTIONS

If you submit creative ideas, suggestions, proposals, reviews, feedback, photographs, testimonials or other materials to us, whether online, by email, by post or otherwise, you confirm that you have the necessary rights to submit those materials.

Where you voluntarily provide comments or contributions for the purpose of publication or promotion, you may grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt, translate and distribute that content for legitimate commercial and promotional purposes, subject to applicable law and any specific agreement between us.

We are under no obligation to keep unsolicited comments confidential, to pay compensation for unsolicited contributions, or to respond to every contribution.

We may monitor, edit or remove any content that we reasonably consider unlawful, offensive, threatening, defamatory, obscene, fraudulent, misleading, infringing, abusive or otherwise contrary to these Terms.

You agree that your comments will not violate any third-party rights, including copyright, trademark, privacy, confidentiality, personality or other proprietary rights.

You further agree not to submit any unlawful, abusive or malicious material, viruses, malware or harmful code.

You may not use a false identity, impersonate another person, provide misleading contact details or otherwise misrepresent the origin of your comments.

You remain responsible for the comments you submit and their accuracy.

SECTION 12 — PERSONAL DATA

The submission of your personal data and its processing by us through the store is governed by our Privacy Policy.

Please see our Privacy Policy for more details on how we collect, use, retain, share and protect personal data.

SECTION 13 — ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our website or within the Service that contains typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping charges, delivery times or availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information where necessary.

Where permitted by law, we may cancel an order if information materially affecting the transaction was clearly incorrect, including in the event of an obvious pricing error.

Where an order is cancelled, any payment already taken for that cancelled order will be refunded in accordance with applicable law.

We are not obliged to update every piece of general information, except where the law requires it.

No specified update or refresh date should necessarily be interpreted as meaning that all information on the website has been changed or updated.

SECTION 14 — PROHIBITED USES

In addition to the other prohibitions set out in these Terms, you are prohibited from using the site or its content:
(a) for any unlawful purpose;
(b) to encourage others to perform or participate in any unlawful acts;
(c) to violate any applicable international, national or local laws, regulations or legal requirements;
(d) to infringe our intellectual property rights or those of third parties;
(e) to harass, abuse, threaten, insult, harm, defame, intimidate or unlawfully discriminate against another person;
(f) to submit false, fraudulent or misleading information;
(g) to upload or transmit viruses, malware or any other malicious code;
(h) to unlawfully collect, monitor or track the personal data of others;
(i) to send spam, or engage in phishing, pharming, pretexting, scraping or any other abusive automated activity;
(j) for any obscene or unlawful purpose;
(k) to interfere with or circumvent the security features of the Service, the website, related websites or the internet;
(l) to carry out fraudulent chargebacks, abusive refund activity or misuse of promotional offers;
(m) to attempt any unauthorised access to accounts, systems, networks or data.

We reserve the right to suspend or terminate access to the Service for any breach of these prohibited uses.

SECTION 15 — PRODUCT INFORMATION AND GENERAL DISCLAIMER

Information made available by PawVitalCo, including product pages, blogs, eBooks, guides, advertisements, educational content and customer communications, is provided for general information purposes.

Our products are intended to be used in accordance with the instructions, warnings and guidance provided with the relevant product.

Each animal may respond differently to products.

It is your responsibility to determine whether a product is suitable for your dog, taking into account any known allergies, sensitivities, existing conditions, medications and veterinary advice.

If your dog has a diagnosed medical condition, is pregnant, is nursing, is taking medication, has known allergies or sensitivities, or if you have concerns about their health, you should seek the advice of a qualified veterinarian before introducing a new supplement.

PawVitalCo products and information materials are not intended to replace professional veterinary diagnosis, treatment or advice.

No information on our website should be interpreted as a guarantee that a product will prevent, diagnose, treat or cure any disease or medical condition, except where expressly and lawfully permitted.

In an emergency, or if an animal appears seriously unwell, contact a veterinarian promptly.

SECTION 16 — DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not warrant that access to our website or online Service will always be uninterrupted, timely, secure or error-free.

We do not warrant that every result obtained from the use of the online Service will be perfectly accurate or reliable.

From time to time, we may temporarily suspend parts of the Service for maintenance, security, operational or technical reasons.

To the fullest extent permitted by law, the website and the online Service are provided "as is" and "as available".

However, nothing in these Terms excludes or restricts any warranty, condition, right or remedy that cannot lawfully be excluded under applicable consumer law.

Nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence, where such liability cannot lawfully be excluded;
fraud or fraudulent misrepresentation;
breach of statutory rights whose exclusion is prohibited;
or any other liability that cannot lawfully be excluded or limited.

Subject to the above, and to the fullest extent permitted by law, PawVitalCo, its operator, directors, officers, employees, affiliates, agents, subcontractors, suppliers, service providers and licensors shall not be liable for losses that were not reasonably foreseeable when the relevant contract was entered into, or that result from circumstances beyond our reasonable control.

Where you use the Service for business or commercial purposes, additional limitations may apply to the fullest extent permitted by law.

Nothing in this section affects your statutory rights as a consumer.

SECTION 17 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless PawVitalCo, its operator, parent companies, subsidiaries, affiliates, partners, officers, directors, agents, subcontractors, licensors, service providers, suppliers and employees, against any third-party claim arising directly from:
your material breach of these Terms;
your unlawful use of the Service;
your infringement of third-party rights;
or your violation of applicable law.

This section does not require a consumer to indemnify us for matters caused by our own negligence, breach of contract or unlawful conduct.

SECTION 18 — SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will nevertheless be enforceable to the fullest extent permitted by applicable law.

Any unenforceable part will be deemed severed from these Terms, without affecting the validity and enforceability of the remaining provisions.

SECTION 19 — TERMINATION

The obligations and liabilities of the parties incurred before termination will survive termination where their nature requires it.

These Terms remain in effect until terminated by you or by us.

You may stop using our Services at any time.

Where we reasonably consider that you have materially breached these Terms, we may suspend or terminate your access to the Services, subject to applicable law.

Termination does not remove any obligation to pay amounts validly due before it.

SECTION 20 — ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms of Service, together with any policies and operating rules posted on our site or expressly incorporated by reference, constitute the agreement between you and us regarding your use of the Service.

They supersede any prior communications or proposals relating to the same subject matter, unless otherwise agreed in writing.

Nothing in this section limits any statutory rights you may have.

SECTION 21 — GOVERNING LAW

These Terms of Service, and any separate agreement under which we provide Services to you, are governed by and construed in accordance with the law of England and Wales.

If you are a consumer resident in the United Kingdom, you also benefit from the mandatory protections of UK consumer law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Nothing in these Terms removes consumer protections that cannot lawfully be excluded.

SECTION 22 — CHANGES TO THE TERMS OF SERVICE

You can review the most current version of these Terms of Service on this page.

We reserve the right to update, change or replace any part of these Terms by posting changes to our website.

Where required by law, material changes will apply going forward and appropriate notice may be given.

Continuing to use or access the website after the changes take effect constitutes acceptance of those changes, to the extent permitted by applicable law.
